By accessing or using CritchPitch ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. If you are using the Service on behalf of a minor, you represent that you are the parent, legal guardian, or authorized coach of that minor and accept these terms on their behalf.

CritchPitch is a pitching mechanics screening and training insights platform. It uses AI-powered pose estimation to analyze pitching video and identify movement patterns associated with stress indicators identified in published biomechanics research.

CritchPitch is not:

• A medical device, medical diagnosis, or clinical assessment
• An injury prediction or injury prevention tool
• A substitute for evaluation by a qualified healthcare professional
• A treatment plan or rehabilitation program

Our screening results identify movement patterns and stress indicators. They do not diagnose injuries, predict future injuries, or prescribe medical treatment. The data presented in your report is informational. What you do with that information is your decision. We inform; we do not prescribe.

If you or your athlete experience pain, discomfort, or have concerns about injury, consult a qualified sports medicine professional.

You must be at least 18 years old to create an account. Accounts for athletes under 18 must be created by a parent, guardian, or authorized coach. By creating an account for a minor, you confirm that you have the authority to do so and accept responsibility for the minor's use of the Service.

You are responsible for keeping your login credentials secure. Notify us immediately if you suspect unauthorized access to your account.

When you upload a pitching video, the video is processed entirely within your web browser using on-device pose estimation. Your video is never uploaded to, stored on, or transmitted to our servers. We only receive and store the numerical screening results (joint angles, pattern scores, risk classifications). See our Privacy Policy for full details on data handling.

Screening results depend on the quality of the uploaded video (angle, resolution, frame rate, lighting, and visibility of the pitcher). Results from a single video represent a snapshot of mechanics at that moment and may not reflect the pitcher's typical delivery. Factors such as fatigue, intent, game vs. bullpen setting, and pitch type can all affect mechanics.

Our pose estimation technology uses 2D landmark detection. It does not capture 3D joint forces, torques, or internal tissue loading. Movement patterns flagged as "elevated" or "monitor" indicate patterns that biomechanics research has associated with increased stress indicators. They do not confirm that stress or injury is occurring.

Workload tracking features are based on self-reported throw counts and activity logs. Their accuracy depends on the data you provide. Rest day and workload recommendations are general guidelines, not individualized medical advice.

CritchPitch offers free screenings (limited per email) and paid subscription plans. Subscriptions are billed monthly or annually through Stripe. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods.

We reserve the right to change pricing with 30 days notice. Price changes do not affect active subscription periods.

You agree not to:

• Use the Service to diagnose, treat, or make clinical claims about injuries
• Upload videos of individuals without their consent (or parental consent for minors)
• Scrape, reverse-engineer, or programmatically access the Service
• Resell, redistribute, or commercially repurpose screening reports without permission
• Misrepresent CritchPitch screening results as medical advice, diagnosis, or clearance
• Use the Service for any illegal purpose

The CritchPitch platform, including its analysis algorithms, report templates, drill prescriptions, interface design, and brand assets, is owned by CritchPitch. You may share your individual screening report via the share link provided. You may not copy, reproduce, or commercially redistribute the platform's content, design, or analysis methodology.

Your screening results belong to you. You may share, print, or discuss your report with anyone you choose.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SCREENING RESULTS WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRITCHPITCH AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOST DATA, OR RELIANCE ON SCREENING RESULTS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Baseball and pitching involve inherent physical risks including, but not limited to, muscle strain, ligament injury, and overuse injuries. You acknowledge that CritchPitch screening results are informational only and that participation in any sport, training program, or exercise involves risk of injury. You assume full responsibility for any training decisions made based on information provided by the Service.

You agree to indemnify and hold harmless CritchPitch, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time by emailing nathan.critch@outlook.com. Upon termination, your right to use the Service ceases immediately.

We may update these terms from time to time. If we make material changes, we will notify users via email or a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these terms or your use of the Service shall be resolved in the courts located in Texas.
